Heart attacks and strokes can be compensable

Heart attacks (otherwise known as myocardial infarctions) and strokes often happen at work. Heart attacks and strokes can be covered by workers’ compensation, but there are special rules under Georgia workers’ compensation law that apply to strokes and heart attacks, making them particularly difficult to prove.

One of the special rules for heart attack and stroke injuries is a requirement of medical evidence. This means to maintain a claim  there must be evidence from a doctor that the job caused or contributed to the heart attack or stroke. Usually the initial treating  doctor provides the medical support.  However, evidence could also come from a doctor who did not provide any treatment but reviewed medical records and other information and gave an opinion.  The nature of medical evidence required is best evaluated by an attorney due to the technical requirements of the law.

If you have been suffered a heart attack or stroke on the job or immediately following work and believe that you have a valid workers’ compensation claim,  but are being given the run around by your employer or insurer, you should consider hiring an attorney.  At Kenneth R. Croy and Associates we can help you to understand your rights and pursue the workers’ compensation benefits that you are entitled to.
